Terms of Service

These Terms of Service ("Terms") govern your access to and use of Avron ("we", "our", or "us"), a private server management dashboard for Emergency Response: Liberty County (ER:LC). By creating an account or using Avron in any way, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 13 years of age to use Avron, consistent with the minimum age required by Roblox's Terms of Service and Discord's Terms of Service. By using Avron you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials, including your ER:LC server key stored within Avron. You are responsible for all activity that occurs under your account. You agree to notify us immediately through our Discord server if you believe your account has been compromised. You may not share your account, sell access to it, or use it on behalf of others without our written consent.

All purchases are final. We do not issue refunds as a standard practice. Refunds may be considered on a case-by-case basis at our sole discretion. To request a refund, contact us through our Discord server with the reason for your request. Refund requests must be submitted within 30 days of the charge in question. We are not obligated to grant any refund request outside of the circumstances described below. Service downtime: "Significant downtime" is defined as a continuous, verified service outage of 24 or more consecutive hours caused solely by Avron's own infrastructure. If such an outage occurs, we may, at our discretion, issue a partial refund or account credit proportional to the affected period. We will not issue refunds for downtime or disruptions caused by third-party providers outside our control, including but not limited to: Discord API outages, Roblox or ER:LC API outages, Stripe payment disruptions, Supabase or other hosting provider incidents, or general internet infrastructure failures. These are circumstances beyond our control and do not constitute a failure of service on our part. Chargebacks: Initiating a chargeback or payment dispute with your bank or card issuer without first contacting us and allowing us a reasonable opportunity to resolve the issue is a breach of these Terms and may result in immediate account suspension pending resolution.

Avron is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or perfectly secure operation of the service at all times. We may perform scheduled or unscheduled maintenance that temporarily interrupts service. We will make reasonable efforts to provide advance notice of planned maintenance. We reserve the right to modify, suspend, or discontinue any feature or the entire service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation. Permanent shutdown: In the event that Avron permanently and completely discontinues the service, users on active paid plans at the time of shutdown will receive a pro-rated refund for the unused portion of their current billing period. This applies only to a full service shutdown and does not apply to the removal or modification of individual features.

We reserve the right to suspend, restrict, or permanently terminate your account at any time, for any reason or no reason, with or without prior notice. Reasons may include, but are not limited to, violation of these Terms, suspicious or abusive activity, non-payment, or at our sole discretion. Upon termination, your right to access the service immediately ceases. Provisions of these Terms that by their nature should survive termination, including ownership, warranty disclaimers, limitations of liability, and dispute resolution, will survive. Termination for cause: If your account is terminated due to a violation of these Terms, no refund will be issued for any unused subscription period. Termination without cause: If we terminate your account for reasons unrelated to a Terms violation, you will receive a pro-rated refund for the unused portion of your current paid billing period. This is your sole remedy in such an event. You may close your account at any time by contacting us through our Discord server. Voluntary account closure is not eligible for a refund.

Avron and all related software, designs, logos, and content are the exclusive property of Avron and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the service solely for its intended purpose. You may not copy, modify, distribute, sell, sublicense, or create derivative works from any part of the service without our express written permission. Your data: You retain ownership of the data and configurations you create within Avron, including server settings, staff configurations, application forms, and ban lists. You grant us a limited, non-exclusive license to store and process that data solely to provide the service to you. Upon account deletion, your data will be deleted in accordance with our Privacy Policy. We do not claim ownership of your content. Avron is not affiliated with, endorsed by, or sponsored by Roblox Corporation or the creators of Emergency Response: Liberty County. All third-party trademarks referenced belong to their respective owners.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, AVRON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Avron integrates with and depends on third-party services including Discord, Roblox / ER:LC PRC, Stripe, and Supabase. These services are governed by their own terms and privacy policies, which you are also responsible for reviewing and accepting. We are not responsible for the availability, actions, or content of any third-party service.

We may update these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you through the dashboard or our Discord server. Continued use of the service after the effective date of updated Terms constitutes your acceptance of the changes.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Informal resolution: Before filing any formal dispute, you agree to contact us through our Discord server and give us 30 days to attempt to resolve the issue in good faith. Binding arbitration: If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration will be conducted in English. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Filing fees will be allocated in accordance with the AAA's Consumer Arbitration Rules. No class actions: YOU AND AVRON AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims. Exceptions: Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction in Delaware to prevent irreparable harm pending arbitration.
